When Tunisia rose up, Ben Ali scoffed … when young people occupied Tahrir Square, Mubarak resorted to paternalism and then mob violence … in Syria, Assad's troops fire daily into the crowds. And on Tuesday, a military style assault on Zuccotti Park – news blackouts, tear gas, closed airspace, an LRAD "sound cannon" – was carried out in the dead of night to take out our movement's spiritual home.For many weeks we had a kind of magic going for us … we held the high ground … we stuck doggedly to our Gandhian ways and blindsided the cynical world with our optimism, our camaraderie, our nonviolence, our determination to forge a different kind of future. With nothing more than twinkling fingers, mic checks, mutual respect, and hope for the future, we sparked a global democracy moment the likes of which the world had not seen since 1968.
But New York's billionaire Mayor decided to snuff us out. We wanted a Tahrir Moment, an American Spring, and he attacked us in the middle of the night while we slept. These kinds of attacks on peaceful protestors did not work in Tunisia, not in Egypt, they are not working in Syria right now, and – wake up Bloomberg & Co! – they are not going to work in America either.
This assault has stiffened our resolve. Now begins the second, visceral, canny, militant phase of our nonviolent march to real democracy. We regroup, lick our wounds and begin our counterattack as early as tomorrow.

«o» Secretary of State Clinton has just finished a jaunt around Asia and the Philippines even as Obama finishes his visit to Australia clinching a Naval basing deal (covered in yesterday's news and commentary) at Darwin. Now they're both off to Bali for the SEATO conference. The discussions will be mostly military, but there are also $25 Billion dollars in trade deals (many of the SEATO countries are 'sweatshop nations') hanging fire as well.

Top story: President Barack Obama visited the northern Australian town of Darwin, a remote location that he called "the perfect place" from which to expand U.S. and Australian military cooperation. Earlier, in the capital of Canberra, Obama and Australian Prime Minister Julia Gillard had announced plans to base 2,500 U.S. Marines in the country.
Obama referred to Darwin as "where our alliance was born," noting that it was devastated by Japanese bombing during World War II, shortly after the Japanese attack on Pearl Harbor. RALEIGH, N.C. (AP) — A major university in eastern North Carolina was locked down for three hours Wednesday when a man carrying a golf umbrella was mistaken for a gunman.
Greenville Police spokesman Sgt. Carlton Williams said emergency dispatchers received two 911 calls about 9:50 a.m. Wednesday reporting a man was walking along a major street near the East Carolina University campus carrying an assault rifle.
Within minutes, the campus alert system was activated, with announcements broadcast over loudspeakers advising students, faculty and staff to stay inside and lock their doors. Written alerts were also sent to campus e-mail accounts and as test messages to cell phones. Nearby elementary schools and a middle school were also put on lock down.
Police soon reviewed traffic camera footage and isolated what appeared to be a man with a rifle sticking out of a backpack.
Dozens of heavily armed officers from at least four law enforcement agencies responded in force, sweeping campus buildings, searching buses and briefly surrounding a nearby house. Snipers took up positions on rooftops. A North Carolina Highway Patrol helicopter hovered overhead... [Salon.com]

«o» There are continuing coordinated attacks on #Occupy camps across the U.S. as the Wall Street protesters in Zuccotti Park spent a cold night obeying a court order that they have no blankets, no tents, and they stay awake all night sitting up straight. More.
Also note mayors from across the country have been strategizing together (still more @ Salon) to "deal" with the Occupy movement. That coordination includes assistance from the Department of Homeland Security and the FBI, which IS strange, considering there have been no federal offenses, and the people involved in the protests are, without a doubt, not 'criminals' or 'terrorists' in any sense of the word.
Meanwhile in Razer's neck of the #Occupation, Good News!
#OccupySantaCruz wins a federal court stay on an injunction against their encampment in a city park. The emergency injunction was cobbled together in a secret city council session and the evidence regarding alleged health and safety issues presented in a closed door court session. That "evidence" is now due to meet the harsh spotlight of a federal court.
However the Santa Cruz #Occupation's Information center on the court house steps nearby is still under threat with sheriffs coming by all night to deliver notices of violation of the state's Penal Code 647(e) which seems to make it illegal to sleep or rest ANYWHERE in the state if one is not 'lodged' ie. welcome. Much of the wording of that law seems to have been 'cribbed' from an 1800s Indiana freed slave travel control law.
So... #OccupySantaCruz Responds with a "Notice" of their own:
For the last week or two, Santa Cruz county sheriffs have arrived nightly at around midnight, with bright lights and video cameras, to hand out these notices on the courthouse steps. The flyers threaten us with arrest and criminal prosecution under questionable 647(e) lodging statute that ostensibly abridges our right to continue political protest after dark. They then typically return in the wee hours of the morning to issue citations and make arrests, and take our tents, sleeping bags, backpacks, protest signs, and other belongings.Personally, I'm still waiting for a response from the city of Santa Cruz that looks like this:
Last night, Santa Cruz occupiers repelled these interlopers by issuing their own notice of “Request of Cease Activity” to the bewildered troop of sheriff’s deputies. While the spoof notices were of equally dubious legal merit as the sheriffs’ own, the occupiers did find the role reversal to be quite empowering. Instead of passively receiving the threats of a body seeking to see us disappear, it restored much cheer to the sleep-robbed protesters to assert that our moral right to peaceful and justice-seeking political protest easily trumps an obscure lodging statute.
As none of the sheriffs would willingly take a flyer from us, we recited the notice to them using the human microphone call-and-response as they retreated to the county building. In our notice, we invited the sheriffs to join the side of the 99% in our attempt to create a better world for all.OCCUPY OF SANTA CRUZ

«o» President Obama is in Australia and Global Hegemony IS on his mind. While no one was looking the Chinese not only dramatically modernized their navy, they've increased the size of their fleets five times as well. So the US is planning on basing it's resupply at already existing Australian bases along the North Shore of Australia and we're also intending to move 150 Marines onto those Australian bases for training. In four or five years the Pentagon intends to garrison 2500 - 3000 troops there, as well as run fleet deployment operations for the Pacific.
«o» In Washington, the Secret Service has found a bullet and a mark on the bulletproof glass at the White House. They have also found an abandoned AK47 in the area. There are no suspects yet.
«o» They DO know where the money went (War...) - While the US has been in the process trying to reduce it's national debt by $1.2 trillion dollars, the soon-to-be $15 trillion dollar national debt has increased by $400 billion dollars since the creation of the all-but-useless "CatFood Commission".

But the BIG story is the NYPD moved on Zuccotti Square in New York last night, clearing the protesters, who are also planning a re-assembly today. So you're considering buying a hybrid car. Or maybe you already have. Good for you! You're saving a bundle on gas and reducing your environmental footprint at the same time. But fuel isn't the only natural resource that your car requires. Its motor also contains a small amount of neodymium, one of 17 elements listed at the very bottom of the periodic table. Known as the rare earths, these minerals are key to all kinds of green technology: Neodymium magnets turn wind turbines. Cerium helps reduce tailpipe emissions. Yttrium can form phosphors that make light in LED displays and compact fluorescent lightbulbs. Hybrid and electric cars often contain as many as eight different rare earths.

Walk down the aisles of your local Best Buy and you'll be hard-pressed to find something that doesn't contain at least one of the rare earths, from smartphones to laptop batteries to flat-screen TVs. They're also crucial for defense technology—radar and sonar systems, tank engines, and the navigation systems in smart bombs.

A few rare-earths mines are slated to open in the United States in the next few years, the most hyped of which is a facility called Mountain Pass in California's Mojave Desert. (It's actually been around off and on since the '50s, but a company called Molycorp has given it a major makeover.) When it's running at full capacity, Mountain Pass will be the largest rare-earths mine in the world, producing upwards of 40,000 tons of the stuff every year.
Which means Molycorp will also have to deal with a whole lot of waste. Rare earths occur naturally with the radioactive elements thorium and uranium, which, if not stored securely, can leach into groundwater or escape into the air as dust. The refining process requires huge amounts of harsh acids, which also have to be disposed of safely. Molycorp claims that its new operations are leak-proof, but the company's ambitious plans have raised a few eyebrows among environmentalists, since the site has a history of spills.
But no matter how quickly new mines open, the United States won't be able to produce enough rare earths on its own—it's thought that North America contains only 15 percent of the world's supply. A recent Congressional Research Service report (PDF) recommended that the US seek reliable sources in other countries.
And that's where the real environmental problems begin. Mines in China have a particularly terrible record of contamination. Communities around a former rare-earths mining operation in Inner Mongolia, for example, blame hundreds of cases of cancer on leaked radioactive waste from the mine, and local people complain that their hair has gone white and their teeth have fallen out.
Right now, our most likely nondomestic rare-earths source is an Australian company called Lynas. Although the company will mine its materials in Australia, it hopes to build its refinery in Malaysia. This idea is controversial among Malaysians, to say the least. [In Full @ Mother Jones]

On the outskirts of one of China’s most polluted cities, an old farmer stares despairingly out across an immense lake of bubbling toxic waste covered in black dust. He remembers it as fields of wheat and corn.
Yan Man Jia Hong is a dedicated Communist. At 74, he still believes in his revolutionary heroes, but he despises the young local officials and entrepreneurs who have let this happen.
‘Chairman Mao was a hero and saved us,’ he says. ‘But these people only care about money. They have destroyed our lives.’

«o» Government will be slow... but sure - Oakland has struck back. The #OccupyOakland protesters in the park across the street from city hall are being arrested and their encampment is in the process of being demolished. There have been about sixty arrests so far after written notification and an order to disperse. Again, there are officers from agencies all over the Bay Area involved in the operation, and one day, SOMEONE is going to have to take resposnibility in public for the bill.

There IS some good news on the legal front though.The #OccupySantaCruz General Assembly achieved consensus this afternoon to kick the legal 'football' into federal court, with filing fees already voted and appropriated, to seek relief from a Santa Cruz city injunction against their city park encampment, on undisclosed evidence, presented in a closed door session of Santa Cruz Superior court after a secret city council meeting.
There MAY BE further consensus on a counter-suit against the city of Santa Cruz California for attempting to violate the first amendment rights (among others) of the people at the encampment considering that legal counsel has informed the General Assembly federal court decisions consistently support camping as an exercise of the First Amendment right to assemble and petition the government for redress of grievances.
We HAVE grievances!
The city of Santa Cruz IS attempting to deny #OccupySantaCruz that right to peaceably assemble, and considering the secrecy of the process that caused the delivery of the injunction, that attempt to deny MAY HAVE occurred under circumstances that could be described as fraudulent, or perjured.

In other words we want them to buy what little we make in return for favored nations status so many of the countries in the Pacific can attain the same trade status with the US as Saipan... ie. "Sweatshop Nations" with the ability to put "Made In America" labels on their slave and indentured worker made products. Obama will also meet with SEATO, the South East Asian Military Alliance, while in the Pacific.

«o» Police and the municipalities who pay them feel the pressure of the #Occupations - A number of cities are under economic pressure due to the nationwide #Occupies so they do "something". Last night Berkeley California's police went after the campers saying they were interfering with shoppers and are in the city park after posted hours. In Oakland they are trying to move the encampment across from city hall TO the city hall grounds (!!?!!), and in San Francisco's Justin Herman park the city has opened a skating rink... where the landed gentry may skate to waltzes while the campers and houseless look on.
MEANWHILE, at Razer's little piece of the #Occupation...
City attorney pursuing Occupy Santa Cruz in court ThursdayWednesday evening's General Assembly followed a raucous demonstration in support of #OccupyEducation UC Santa Cruz students ("Why are there more UC managers than UC professors?") that shut down a local Wells Fargo branch for at least an hour trapping employees inside.
SANTA CRUZ - Members of the Occupy Santa Cruz movement have been told by the city attorney that the city will pursue further legal action against their encampment in San Lorenzo Park.
According to the organization's Legal Strategy and Defense Working Group, the city attorney called Wednesday morning to inform them that the city will ask the court to order Occupy Santa Cruz to appear in court for an order to show cause. That is, members of Occupy Santa Cruz would have to show why the court system shouldn't grant a preliminary injunction that would essentially evict them from San Lorenzo Park.
Last week, the city issued a permit limiting the number of tents to 50, requiring two more on-site portable toilets and citing a number of health and safety concerns, including trash and feces in San Lorenzo Park. The permit gives the campers until Nov. 16 to leave, a deadline which can be extended.
Members of Occupy Santa Cruz planned to discuss the matter at their general assembly Wednesday evening. [Source]
(I think it's the first time the SC County Sheriffs have had a chance to get their single engine airplane in the air for years, and there were bank security officials present, continually filming the incident for their InfraGuard friends.)
The results from the General Assembly so far:
A> Ed Frey (California Barred lawyer, who was responsible for the peacecamp 'homeless' camp-in last year at the county courthouse) of the legal committee seems to think the most efficacious way of dealing with the injunction targeting the encampment is to ignore it, forcing legal delivery on every single participant present, and others who might replace them.
B> There MAY be an agenda item at another time delegating 'agency' to the legal team to represent the encampment, but for the moment, it's been tabled, and it's unclear at the moment whether, at least Ed Frey, would care to take on that role.
In yours truly's estimation, if this is the case, this should be a job for the National Lawyers Guild when the injunction is issued, if they're interested, in coordination with the legal committee.
Yours truly fully and unequivocally supports ignoring the injunction. It has no more of a reason to over-ride the First Amendment to the U.S. Constitution than the city's unrequested 'permit'.

«o» Can you imagine ANY of these people leading your nation? It has been referred to as the worst presidential debate ever held (with 5 0r 6 more to go). For instance, governor Perry of Texas forgot one of the three government departments he was planning to eliminate and it took a cueing from Ron Paul (The EPA!) after Perry stood there looking stupid for almost a minute. Even the know-bodies of the GOP think his campaign is just about done.
«o» The Greek government is in the process of being dissolved and a national unity government will be formed under a gentleman who just happens to be a former officer of the European Central Bank. Meanwhile Italy is in trouble and will form a new government after prime minister Berlusconi steps down shortly. In the meantime Portugal has claimed it's bank is failing with France, Germany, and Britain refusing to put up any more money for national bailouts... nor will the U.S.
«o» No more "fuzzies"! President Obama is going to cut into the federal budget by dis-allowing the purchase of give-away doodads that promote government departments and their projects along with a number of other small actions that will save some minuscule amount of federal money.
