Oakland Cannabis Regulation and Revenue Ordinance
(Text of Oakland Measure Z Tax and Regulate / Lowest Enforcement Priority ballot initiative submitted to City Clerk Feb 19, 2004; approved by 65% of Oakland Voters Nov.2, 2004)
Section 1: TITLE
Oakland Cannabis Regulation and Revenue Ordinance
Section 2: FINDINGS
The people of Oakland, California find as follows:
WHEREAS it is a goal of the people of Oakland to keep drugs off the streets and away from children, and to eliminate street dealing and violent crime; and
WHEREAS each year California spends over $150 million enforcing cannabis (marijuana) laws, expending valuable law enforcement resources that would be better spent on fighting violent and serious crimes; and
WHEREAS medical and governmental studies have consistently found cannabis to be less dangerous than alcohol, tobacco and other drugs; and
WHEREAS otherwise law-abiding adults are being arrested or imprisoned for nonviolent cannabis offenses, clogging our courts and jails; and
WHEREAS controlling and regulating cannabis so that it is only sold by licensed businesses would undermine the hold of street dealers on our neighborhoods; and
WHEREAS in the face of the severe state and local budget crises, the revenues from taxing and licensing cannabis would help fund vital Oakland city services; and
WHEREAS the current laws against cannabis have needlessly harmed patients who need it for medical purposes, and impeded the development of hemp for fiber, oil, and other industrial purposes; and
WHEREAS it is the hope of the people of Oakland that there will be state and federal law reform that will eliminate the problems and costs caused by cannabis prohibition;
THEREFORE the people of the City of Oakland do hereby enact the following ordinance establishing the cannabis policy of the city. [In Full @ CA-NORML]
The Senate has 'Terminated' the F-22 Raptor fighter jet program. The F-22 is a 5th generation fighter plane which costs $350 million for each one, costs $44,000 an hour to fly, and requires 30 hours maintenance for each hour it spends in the air.

Marine Pfc. Bowe R. Bergdahl captured by the Taliban has made a video that at least proves he's alive. In Pashtun society it's generally a good thing if you have a prisoner, he's a negotiating chip... or else... the captive could just end up dead.
The Guantanamo Task Force has delayed it's interim report for six months as the authorities attempt to find other detention facilities for the POWs... even as the US government says they WILL close the facility on schedule, by January 2010.
The Iraqi Foreign Minister has briefed the UN and will be at the White House on Thursday. Expect an announcement that the sanctions on Iraq have been lifted... Sanctions such as it "...continues to pay 5 percent of its oil revenues to Kuwait..." It begs the question... Sanctions on who? Why? The sanctions were all based on rumors of WMDs etc which ALL proved to be absolutely false and in many cases fabrications on the part of one of the sanctioning nations... That's US!
There may be an additional 20,000+- US troops heading for Afghanistan over the next three years according to Defense Secretary Gates. In Da' Buffalo's estimation it won't have any effect on the strategic outcome of our invasion except more civilian casualties, more American body bags, and if the Obama administration has any common sense at all, a relatively fresh rear guard defensive force as the US and other Western nations attempt to extricated themselves from the country.
In Sacramento California, the budget battle continues, or perhaps is about to be resolved.

In news of the NOT-really-so weird, and in relation to today's commentary - Pretty soon, California will be all set for a legal implementation of something done in Winder Georgia, where a local head gave a tech twist to the phrase "Custy Button" ('custy' being the in-vogue term for customer, and the 'button' was always a whimsical hypothetical):
In May, police in Winder, Ga. (pop. 10,200), arrested a marijuana seller with a quite-low-tech delivery system. A wireless doorbell was hidden on a tree in woods alongside a house, and when the buzzer sounded, a bucket was lowered from a second-story window. The buyer put money in, the bucket was raised, and the dope would be sent back down. [In Full]

If I recall correctly, Rather was attempting to interview a delegate from Julian Bond's breakaway Georgia delegation who were about to be forcibly removed from the hall by the Andy Frain security company. The eulogy for Walter Cronkite as "the most trusted man in America" on the CBS "Sixty Minutes" show said a lot about the condition of this nation -- though it did not signify what CBS thought it did. It wasn't about the death of one hugely esteemed individual; it was about the broad institutional failure of TV news in general and the current grievous loss of legitimacy and authority in shaping a national consensus of reality. Watching the old clips of Cronkite delivering the evening news years ago, one couldn't help weighing the contrast with the current spectacle of snide, combative, overbearing idiocy acted out nightly by the likes of Kudlow, Olberman, Kneale, O'Reilly, Matthews, and Dobbs as they shout down their invited guest commentators, pander to their demographic, and diss their rivals for ratings.
It was instructive to notice that the program following "Sixty Minutes" -- in the supreme weekly slot of 8p.m. Sunday -- was a childish and stupid "reality" show called "Big Brother." This said even more about the craven quality of the people currently running CBS. It was also a useful lesson in the diminishing returns of technology as applied to television, since it should now be obvious that the expansion of cable broadcasting since the heyday of the "big three" networks has led only to the mass replication of video garbage rather than a banquet of culture, as first touted.
It should remind us more generally that when a society's operations become broadly fraudulent and unreal, authority and legitimacy wither. This is analogous to the position Barack Obama now finds himself in. He was elected as the politician most trusted in America to change the fraudulent and unreal operations of the US government. Don't bother protesting that all politics is necessarily unreal and fraudulent. If it were so, you'd have to argue that the US Constitution was wholly a fraud, as well as Madison, Jefferson, Hamilton and the rest. It only has strong tendencies in that direction. (The Declaration of Independence was itself a direct strike against the fraud and unreality of British royal governance in America.)
As president, Barack Obama is faced with the essential fraudulence and unreality of the US economy. Notice that, as ominous as they are, the wars in iraq and Afghanistan have generated only minimal protest so far in the early Obama period, despite the fact that they are not operationally different from their conduct under Bush. There is no protest because, for now, a consensus exists that our troops are in these places for perceived reasons -- to keep Mideast oil supply lines open... to keep Islamic maniacs busy in their own backyard instead of on US territory... to keep Iran in a vise... to maintain the American "empire" (take your pick). There's something there to appeal to a broad majority of US voters. Unlike Vietnam, Iraq and Afstan are not perceived as out-and-out frauds.

Wherein it causes us, as individuals in American society, to no longer notice the mayhem we create by our actions around the world
At the top of the news, the Nigerian rebel group MEND declares a ceasefire two months after they declared "all out war". The ceasefire was announced after the the Nigerian government's release of MEND's leader Samuel Okah. (See: Friday, May 15, 2009 No More 'Fun & Games' - Nigeria's MEND declares 'all-out war' in the Niger Delta for a historical overview) Their attacks on Shell oil facilities and other petrochemical infrastructure in the Niger Delta had brought oil output down to 300,000 BPD from a nominal 1 million+.
They have a great sense of humor too, when MEND managed to chase Shell Oil out of the delta for a few years a while back, 435 miles of pipeline simply disappeared... That's more than the distance from San Francisco to Los Angeles (387 miles).
But it's not over for oil wars on the African continent. So lets discuss what's most likely to be our next regional war, the extractive resources war on Africa, with the focus on oil... "AFRICOM, Let's translate the ad-speak. Partnership means: We give you weapons and training and you give us oil".
Partnership sounds nice. But as FPIF contributor Gerald LeMelle argues in Revealing the Real Africa Policy, the administration's Africa agenda make "no reference to the recent FY 2010 budget that doubles the size of AFRICOM's funds. Nor does it mention the doubling of financial support for counterterrorism projects throughout the continent — including increasing funds for weapons, military training, and education at a time when U.S. foreign aid money is stagnating."
And despite his pointed remarks against dictators and military conflicts, Obama neglected to mention Uganda, where AFRICOM supports the Ugandan People's Defense Forces (UPDF) with arms and training. "Northern Ugandans have innumerable stories about the abuses committed by the UPDF in their communities," writes FPIF contributor Beth Tuckey in Denouncing Dictatorship in Uganda. "Although the UPDF's behavior has been slightly better in recent years, it would be a mistake for the United States to train and equip such a force for combat. Museveni has shown no interest in relinquishing his presidency, and yet the United States continues to shower his so-called democracy with aid and military support.

In Nigeria, which will soon provide up to one-quarter of all U.S. imported oil, the government recently launched a full-scale offensive against armed resistance groups in the oil-rich Niger Delta. The Nigerian government receives official military assistance from the United States, as well as tens of millions of dollars in commercial U.S. military sales. "Peaceful resistance of minority ethnic groups across the Niger Delta has been met with brutal military repression and the broken promises of oil companies, with no opportunity for dialogue or genuine negotiation in 50 years," writes FPIF contributor Kia Mistilis in Niger Delta Standoff. "In this environment, the armed resistance group, the Movement for the Emancipation of Niger Delta Peoples (MEND) emerged in 2006. The group targeted oil installations and caused a 40% drop in supply, from 2.4 million to 1.3 million barrels per day" (a 60-Second Expert version of her commentary is here).
So, the United States is indeed helping Africans help themselves…to natural resources and the labor of the disenfranchised.

Currently, the Cost of War Has Topped $915 Billion Dollars ($687 billion for Iraq $228 billion for Afghanistan)
NOW, let's focus on what that money buys... such as the US-CIA backed Opium growing mercenaries in Afghanistan... The Northern Alliance.
Northern Alliance leader Abdul Rashid Dostum who is about to be reappointed as military chief of staff to the Afghan president has been accused of massacring 2,000 surrendered Talib by Physicians for Human Rights.
PHR is calling on the US government to stop covering it up and begin a full investigation... This has also been demanded or requested by officials from the FBI, the State Department, the Red Cross and other human rights groups.
Allegedly Dostum's fighters, WHILE HE WAS ON CIA PAYROLL, put the captured Talib fighters in container trucks where many died from the heat/lack of water while others either simply suffocated or were killed when Dostum's crew sprayed the containers with gunfire, and then buried them in a mass grave, which according to reports has been tampered with, including the removal of large quantities of soil.

Mr. Bout, now in jail after his apprehension by INTERPOL, was the 'gentleman' who 'lost' 200,000 AK47s for the Pentagon which were due to be delivered to the Iraq Security forces. General Petraeus wrote the whole affair off as a 'bookkeeping error'. The Matthew Shepard bill (The bill is named for Matthew Shepard, the Wyoming college student who was targeted because he was gay in a fatal attack in 1998.) which would add attacks due to sexual preference to the list of federal hate crimes, currently on the Senate back-burner, has been added to the defense appropriations bill. Expect to see some truly homophobic behavior from at least the Republicans who DON'T play footsie in airport bathroom stalls... Also, President Obama says if the F-22 fighter is included in that appropriations bill, he will veto it on that basis alone. See: "Despite Veto Threat, Senators Debate F-22 Funds". The Cloture vote is due today or they WILL go into overtime
The non-aligned nations meeting in Egypt has been told by North Korea that there WILL BE NO OF EXPECTATION OF RESUMPTION of the six party talks and the US is seeking a confrontation. There have also been off-the-camera meetings between India and Pakistan about mutual-interest terrorism issues.
I wouldn't suppose it made them any more productive - Capitol Hill was locked down for a couple of hours yesterday due to a high speed chase with shots fired. No word what it was about... Perhaps an unemployed defense industry lobbyist who had been working the F-22 contract robbed a 7-11.
The Senate confirmed ex-astronaut Bolden to head NASA yesterday and the Space Shuttle Endeavour FINALLY got off the ground for it's trip to the International Space Station with parts and accessories. There will be 13 astronauts on board the ISS... a new record.
The fighting in Helmand province Afghanistan is a go-it-alone affair for the US and NATO with more casualties as the Afghani government offers no more troops to support the offensive and the ones in the field are getting killed. You'd think we've worn out our welcome, if we ever actually had one.

The Mexican state of Michoacan is at war. What started as a federale intervention into a drug cartel's activities has turned into a full scale war on the government of Mexico in the region. Add that to the Zapatistas in the South and other socially upset elements of Mexican society, and the Mexican government may be seriously threatened from within.
Your tax dollars at work - The Department of Homeland Insecurity is going to spend some of your money to study on whether or not they're wasting your money on the color coded DHS alert system. Every time the alert level changes, millions of your tax dollars go to alerting all state agencies connected by law to the DHS, the National Guard, etc. "The alert level has not been changed since 2006 when it was raised from yellow to red then lowered to orange in the aviation sector"The 3.1 BILLION dollar super helicopter program (The VH-71) developing the new short-hop presidential whirly-ride has been scrapped. Since they apparently don’t own TVs or DVD players, researchers at Robotic Technology, Inc. are developing battlefield machines that can fuel themselves with collected organic matter. The experts say such fuel “could” include human corpses, but if you picked up anything on flesh-eating robots over the years you know they’ll ignore that tasty soybean field and make a chow line right to the nearest corpse. Regina Marcia Benjamin was born on Oct. 26, 1956, in Alabama, the daughter of a maid. The government helped pay for her medical studies in exchange for a promise to serve the poor for a few years. So she helped build a clinic in a shrimping town about 25 miles south of Mobile, Ala.More about both nominees @ DemocracyNow!
When Hurricane Georges sent five feet of water surging into the clinic in 1998, she made house calls until it was rebuilt.
When Hurricane Katrina destroyed the clinic again seven years later, she mortgaged her house to rebuild. And when a fire destroyed the rebuilt clinic the day before it was set to reopen, she sent out appeals across the country for aid to build again.
Stan Wright, Bayou La Batre’s mayor, said Dr. Benjamin had driven a Toyota pickup with mud tires in the aftermath of Hurricane Katrina to tend to her patients wherever they lay. Mr. Wright is on the clinic’s board of directors. Its finances have been so shaky that it has not been able to pay her for years, he said.
“The clinic owes her over $300,000,” Mr. Wright said.
Audrey Nel Bosarge, a nurse who worked side by side with Dr. Benjamin for 19 years, said Dr. Benjamin routinely made house calls to shut-ins. She has paid for medicines out of her own pocket for some who could not afford them, Ms. Bosarge said.

Now, despite MASSIVE lobbying for it's funding, Obama says he'll veto the WHOLE 2010 military spending bill if it appears in it.
